This is a website of Premiers bv, a Belgian company with registered office at Vogelzangdreef 2, 8400 Oostende, Belgium (hereinafter “we” or “Jeune Premier”). Our company number is BE 0502.478.410.

On this website we process personal data about you.

This privacy notice explains how we, as data controller, process your personal data, and what your rights are in this regard. We only process your personal data in accordance with applicable data protection legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation or GDPR).

This privacy notice may change from time to time in response to new developments. The most recent privacy notice can be found at www.jeunepremier.be. We recommend that you consult this privacy notice regularly in order to be aware of any changes. You will always see the latest date of amendment.

1.      What personal data do we collect?

When you visit our website, we collect your contact details (such as your name, (email) address, telephone number,) when you create an account, complete a purchase, subscribe to our newsletter or post messages/questions. We also collect your payment details when you make a purchase.

We keep the data in your account as long as you are an active customer with us. If you have not logged in with us for [5] years, we will delete all your personal data. [a]

2.      The purposes for which we process your personal data and applicable legal basis Your personal data is processed:

    to send your purchases to you or when you want to return purchases to us;

    to notify you of updates to our website;

    to be able to serve you an account structure on our website and give you the best possible experience when visiting out website[b]

    to send you our newsletters;

    to respond to your queries; for after sales/client service; and

    for direct marketing purposes. [c]

If we intend to further process the personal data for a purpose other than that for which the personal data were collected, we will provide you prior to that further processing with information on that other purpose and the required information under the GDPR.

If you do not provide these personal data, you may not be able to make a purchase, get in touch with us, or benefit from our services.

We only process personal data on one of the following legal basis:

(a)    you have given consent to the processing of your personal data for one or more specific purposes;

(b)    processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; and

(c)    processing is necessary for compliance with a legal obligation to which the controller is subject.

3. Personal data of children

Our website is not directed to process the personal data of children. The use of this website by customers under the age of 16 is only allowed with the express consent of a parent or guardian.

4. Your rights and how you can exercise them

You may exercise the following rights:

       Right of access: you have the right to obtain confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, obtain a copy of your personal data from us;

       Right to rectification: you have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you. You also have the right to have incomplete personal data completed, including by providing a means of supplementary statement;

       Right to erasure: you have the right to obtain the erasure of your personal data without undue delay where one of the following grounds applies:

o       Your personal data are no longer necessary in relation to the purpose for which they were collected;

o       You withdraw your consent and there is no other legal ground for processing;

o       You object to the processing and there are no overriding legitime grounds for such processing;

o       Your personal data have been unlawfully processed;

o       Your personal data have to be erased for compliance with a legal obligation in Union or Member State law to which we are subject.

Please note that your right to erasure will not apply for:

o       exercising the right of freedom of expression and information;

o       compliance with a legal obligation which requires processing by Union or

Member State law to which we are subject; o reasons of public interest in the area of public health in accordance with points (h) and (i) of Article 9 (2) as well as Article 9 (3) of the GDPR;

o       archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with the GDPR; or

o       for the establishment, exercise or defence of legal claims.

       Right to restriction of processing: you have the right to obtain restriction of processing where one of the following applies: o You contest the accuracy of your personal data, for a period enabling us to verify their accuracy;

o       The processing is unlawful and you oppose the erasure of your personal data and request and request restriction of their use instead;

o       We no longer need your personal data for the purposes of the processing, but you require them for the establishment, exercise or defence of legal claims.

Please note that this applies without prejudice to our right to continue processing your personal data for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

If you have requested restriction of processing, we will inform you before such restriction is lifted.

       Right to data portability: you have the right to receive your personal data in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from us, where the processing is:

o       based on your consent or a contract; o     carried out by automated means.

       Right to object to processing: if you sign up to one of our newsletters or alerts, you have the right to object at any time to processing of your personal data for direct marketing purposes by clicking on the unsubscribe button in the relevant alert or newsletter;[d]

       Right to withdraw consent: you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

We will respond to your query without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of requests. We will inform you of any such extension within one month of receipt of the request, together with the reasons for the delay.

Where requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may either:

       charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested; or refuse to act on the request.

Make sure that it is always clear exactly which right you want to exercise and in what way (e.g. email, post, …) you wish to receive the information. Please note that we may request the provision of additional information necessary to confirm your identity.

You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of your personal data infringes the GDPR. 5. How we share your personal data

Subject to applicable law and regulations, we share personal data that we collect or you provide with service providers acting on our behalf for the purposes listed above in this notice as well as in our cookie policy. We require these service providers by contract to only process personal data in accordance with our instructions and as necessary to perform the services on our behalf or in compliance with applicable law (e.g. invitation mailing and newsletter distribution providers, website administration services). 6. How we share your personal data and international data transfers

As a rule, your personal data is stored in the European Economic Area (EEA) and is not shared with third parties. There are 2 exception to this rule though.

The first being that we make use of several apps and platforms that are made and maintained by US and Canada based companies. The relevant ones are listed below:

The second exception as explained in our cookie policy, we rely on providers in the US for the use of cookies. [g] Personal data that we collect from you in that context can be transferred to the US. We have implemented international data transfer agreements on the basis of EU Standard Contractual Clauses in order to provide appropriate and suitable safeguards for personal data being transferred to countries outside the EEA where an adequate level of protection is not already guaranteed.
